These Subscription Terms explain MyMEX pricing, billing, card capacity, renewal, cancellation and payment-provider responsibilities.
The order presented before PayPal approval identifies the customer, active-card capacity, billing frequency, price version, currency and total. The subscription begins when PayPal confirms activation (the Activation Date). No paid capacity is activated merely because an account or workspace was created.
Each new paid subscription has an initial fixed commitment of 12 months from the Activation Date. Monthly billing is a payment frequency during that 12-month commitment and is not a one-month contract. Annual billing charges the displayed discounted annual amount for the initial 12-month term.
Prices are calculated from approved active-card capacity and the published price version shown before checkout. PayPal processes recurring payments under its own terms. Taxes, exchange costs or provider charges apply only where displayed or required by law. The customer authorises the payment schedule approved in PayPal.
Each active, non-archived card consumes one purchased card place. Archived cards remain stored without consuming paid capacity. Added capacity is subject to the current published price, PayPal approval and the existing subscription end date; adding capacity does not silently restart an existing commitment. Capacity cannot be reduced below the current active-card count.
Where required by law, Motoring Excellence will provide a recorded expiry notice between 40 and 80 business days before the end of the fixed term. The notice will identify the expiry date, any material changes and the available options to terminate, continue month-to-month or expressly accept another fixed term.
Another 12-month annual term is available at the annual price or discount displayed in the renewal order. It begins only after an authorised customer representative expressly accepts the renewal and completes any required PayPal approval. Silence or continued platform use alone does not create another fixed annual term for a customer protected by mandatory fixed-term consumer law.
If the customer does not terminate or expressly accept another fixed term, the agreement continues month-to-month after the initial term where required by applicable law. Monthly-billed subscriptions continue on their approved monthly payment schedule. An annually billed customer may need to approve a monthly PayPal schedule before further monthly charges can be collected.
A cancellation request must be submitted in writing or another recorded form through support or another available cancellation workflow. Where section 14 of the Consumer Protection Act applies, the customer may cancel on 20 business days’ recorded notice. The customer remains liable for amounts due up to the effective cancellation date, and Motoring Excellence may charge only a reasonable cancellation amount permitted by law, taking account of services provided, discounts granted, the original term, notice and the ability to mitigate loss. A charge may not negate a statutory right to cancel.
Section 14 of the Consumer Protection Act does not apply to transactions between juristic persons. A company or other juristic customer remains bound by its accepted fixed term, subject to other applicable law and any written order-specific cancellation right. Motoring Excellence may agree a reasonable early exit in writing without waiving its rights in other cases.
A month-to-month subscription may be cancelled on 20 business days’ recorded notice. No early fixed-term cancellation charge applies after the initial term, but fees remain payable through the effective cancellation date. Stopping a PayPal automatic payment is evidence of a billing instruction but customers should also use the MyMEX support or cancellation workflow so access, data and final account treatment can be confirmed.
Completed periods are not automatically refundable. Any refund or credit will be determined under applicable law, the value already supplied, amounts still belonging to the customer, the reason for cancellation and any written commercial approval. Nothing in these terms removes a mandatory refund, cooling-off or remedy right.
PayPal may retry a failed payment. Motoring Excellence may provide a reasonable grace period and then suspend publishing or administration if payment remains overdue. Suspension does not erase tenant data or waive lawful amounts due. Access will be restored after verified payment or another approved access arrangement.
A trial does not create a PayPal charge and does not automatically convert into a paid subscription. A paid term begins only after a separate order and PayPal approval. Complimentary or trial access may expire or be withdrawn according to its stated conditions, subject to any separate written agreement.
MyMEX stores the accepted document version, acceptance time, authorised account, order context and document fingerprint. The person approving checkout confirms authority to purchase for the named customer. Customers must promptly correct an incorrect legal-party classification.
A signed enterprise order or statement of work may add specific commercial terms. If it conflicts with these Subscription Terms, the signed order controls only for that subject. Mandatory South African consumer rights always prevail to the extent they cannot lawfully be varied.
